Know before you sign

Six things to understand about a bail bond.

The premium isn't refunded

The bondsman's fee — commonly around 10% of the bail, set or capped by state law — is what you pay for the service, even when the case ends.

Collateral may be required

For larger bonds a bondsman may ask for collateral — a car title, property or other assets — returned when the case closes.

A cosigner is responsible

If you cosign and the person misses court, you can owe the full bail amount. Only cosign for someone you trust to appear.

Every court date matters

Missing court can forfeit the bond and lead to a warrant. Keep every date and stay in touch with the bondsman.

Check the license

Bail agents are licensed by the state. Ask for the license number and get every fee and term in writing.

Not every state uses bail bonds

A few states — including Illinois, Kentucky, Oregon and Wisconsin — don't allow commercial bail bonds. Ask the court about release options there.

Bail bond questions

How much does a bail bond cost?+

You pay the bondsman a premium, commonly around 10% of the bail amount; many states set or cap the rate. On $10,000 bail that's often about $1,000. Ask for the exact fee before you sign.

How fast can someone get out on a bail bond?+

Once the bond is posted, release often happens within a few hours, but it depends on how busy the jail is and how long booking takes.

What do I need to call a bail bondsman?+

The person's full name and date of birth, the jail they're in, the booking number and the bail amount if you have it — plus your ID and a way to pay.

Do I get the bail bond fee back?+

No. The premium is the bondsman's fee. If you paid the full bail in cash directly to the court instead, that is generally returned after the case, minus any fees.

What happens if they miss court?+

The court can forfeit the bond and issue a warrant. The bondsman will look for them, and the cosigner can owe the full bail amount.

Do I need a lawyer as well as a bondsman?+

Yes. The bondsman gets them out; a criminal defense lawyer handles the case. Many people call both the same day.
